Terms & Conditions

1 Purpose & Definitions

These Terms and Conditions constitute a legally binding agreement between Tito's Decoration & Home Services ("Company", "we", "us", or "our"), registered in England and Wales (Company No. 15966367), the individual or corporate customer commissioning interior or exterior works ("Client", "you", or "Homeowner"), and any registered trade professional or subcontractor undertaking tasks via our network ("Trade Partner" or "Decorator").

By booking a site survey, approving a formal quotation, submitting a trade partner application, or utilizing our services, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions.

2 Quotations, Scope & Fixed Estimates

All online estimates generated through our interactive calculators are intended as indicative benchmarks based on standard UK room dimensions and room condition parameters. A formal, binding quotation is issued following a site survey, digital photo assessment, or architectural plan review.

• Formal quotations remain valid for thirty (30) calendar days from the date of issuance.
• Quotations strictly encompass the specified rooms, surface repairs, priming, coat counts, and named decorative materials.
• Any undisclosed pre-existing damp, structural defects, blown plaster, or asbestos requiring specialist remediation shall be assessed separately prior to commencing adjacent work.

4 Client Responsibilities & Site Access

To ensure flawless execution and adhere to agreed project durations, the Client agrees to:

• Provide uninterrupted access to the premises during standard working hours (typically 8:00 AM to 5:00 PM, Monday through Saturday, unless otherwise agreed in writing).
• Ensure a reliable supply of mains running water, electricity, and adequate lighting on site throughout works.
• Remove valuable, delicate, or irreplaceable personal items, artwork, and electronics from the working zones prior to start day.
• Keep domestic pets and minors away from working zones, ladders, scaffolds, and wet paint surfaces for health and safety reasons.

5 Workmanship & Premium Materials

All decorating and renovation tasks are executed to the highest British trade benchmarks. We utilize trade-grade formulations (Dulux Trade Diamond Matt, Crown Trade Clean Extreme, Farrow & Ball Estate Emulsion, Little Greene, or client-specified designer paints).

Our teams enforce clean dust-sheet protocols, floor protection boards (Correx / Ram Board), and dust-extracted sanders (Mirka / Festool) to minimize disruption in residential homes.

6 Scope Changes & Additional Variations

If during the project the Client requests extra services (e.g. additional coat of woodwork paint, radiator painting, wallpapering an additional wall, or minor carpentry repairs), a written Variation Order will be provided with an itemized cost and timeline extension.

No extra charges will ever be invoiced without prior explicit written or verbal authorization by the Client.

8 Cancellations, Postponements & Rescheduling

We understand that construction schedules, move-in dates, and personal circumstances can shift.

• Client Postponement: You may reschedule your reserved start day free of charge by providing at least forty-eight (48) hours' written notice before the scheduled start date.
• Late Notice (Under 24h): In cases of cancellation with less than 24 hours' notice where decorators and bespoke tinted paints have already been dispatched, a nominal call-out preparation fee may apply to cover materials ordered specifically for your project.
• Company Rescheduling: In rare cases of force majeure, severe transport disruption, or adverse weather affecting exterior paint curing, we will promptly notify you and reschedule to the earliest mutually acceptable date.

9 Tito's Guarantee & Snagging Rectification

Every project is protected under Tito's Guarantee. Before final handover and payment of the 80% balance:

• A complete walk-through inspection is conducted with the Client to compile any snagging points.
• Any brush marks, flashing, uneven lines, or missed trims are rectified immediately free of charge.
• We provide a 24-Month Workmanship Warranty covering peeling, flaking, or blistering caused by defective trade preparation or application. Normal wear and tear, physical impact, or structural building movement are excluded.

10 Limitation of Liability & Statutory Rights

Nothing in these Terms excludes or limits our liability for death or personal injury resulting from negligence, fraud, or any liability that cannot be excluded under the UK Consumer Rights Act 2015.

Tito's Decoration Ltd carries comprehensive Public Liability Insurance. In no event shall our total aggregate liability for direct physical damage to property exceed the total project value or £2,000,000 under our insured policy limit. We are not liable for indirect or consequential financial losses.

11 Governing Law & Jurisdiction

These Terms and Conditions, and any contractual or non-contractual disputes arising from or in connection with them, shall be governed by and construed in accordance with the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the Courts of England and Wales sitting in London.
